Conditions of Participation
Participation in the promotion of OOONO A/S, hereinafter referred to as the organizer, is governed exclusively by these conditions of participation. Participation in the promotion is free of charge.
By participating in the promotion, the respective participant agrees to these conditions of participation:
1. Organizer
The promotion is organized by OOONO A/S, located at Gearhalsvej 1, 2500 Valby, Denmark. For inquiries, the organizer can be contacted at support@ooono.com or +49 30 417 35003. Further information about OOONO A/S is available at https://ooono.com/de/pages/impressum.
2. Campaign Period
The promotion begins on September 29, 2024 at 4pm and ends on November 20, 2024 at 11am.
3. Eligibility to Participate
Participation in the promotion is open to all natural persons aged 18 and over resident in Germany who have purchased a CO-DRIVER NO1 or CO-DRIVER NO2 by the end of the promotion period (see section 2) and have registered the device in the OOONO app (see section 4). Employees of the organizer and family members living in the same household are excluded from participation.
4. Participation Requirements
a) First-time buyer of a CO-DRIVER NO1 or NO2
If a customer purchases a CO-DRIVER NO1 or CO-DRIVER NO2 during the promotion period and registers the device in the OOONO app they can also register to take part in the promotion at https://ooono.com/pages/win-a-car. The purchase can be made via a stationary retailer or online.
b) Already registered CO-DRIVER users
Registration of a device alone does not entitle the user to participate in the promotion. CO-DRIVER users who have already registered their device and wish to take part in the promotion must also register via the following link https://ooono.com/pages/win-a-car.
Participation is only possible within the promotion period (see section 2.). Registrations made after the closing date will not be included in the promotion. Only one entry per participant is permitted. The purchase of multiple devices does not increase the chances of winning.
5. Course of the Action
The campaign runs in seven phases, which are published via YouTube and various social media channels.
- In the first phase, the organizer's cooperation partner Hamid Mossadegh is introduced and given the task of selecting a suitable car as a prize.
- In phases two to four, Hamid Mossadegh tests three different cars and finally chooses one of the three cars as the winner of the campaign at his own discretion.
- In the fifth phase, the selected car will be designed by one of the organizer's designers.
- In the sixth phase, the car will be presented in its final design at an event as the winner of the campaign and shown on a retail tour lasting approximately one month at various locations in Germany. The locations and times of the event and the tour will be announced separately by the organizer.
- In the seventh and final phase, the winner is chosen at random and the car is handed over to them as a prize.
6. Prize/Win Determination/Notification and Handover of the Prize
a) Profit
The prize is a car with a market value of approximately EUR 100,000. The details of the car will be announced during the duration of the promotion as described in section 5.
b) Determination of profit
The winner will be determined on November 20, 2024 as part of a random draw among all participants. The name of the participant determined in this way will be published on the organizer's website.
c) Notification
The participant named above will be informed immediately of his/her draw via the e-mail address and/or telephone number provided at the time of registration. Participants must ensure that they can be contacted via the contact details provided at the time of registration.
If the organizer does not reach the participant drawn and the participant does not contact the organizer within three days (72 hours) of being notified that he or she has been drawn, the organizer is entitled to draw another participant.
As soon as the Organizer has reached the participant drawn, it will check whether the participant drawn meets all the requirements set out in these Terms and Conditions of Participation (including the provisions on participation under Section 8 a) and b)). Only then will he or she be declared the winner of the prize.
The above procedure applies to all further draws until a winner is determined.
d) Handover of the prize
The prize will be handed over exclusively to the winner. The handover location will be announced during the campaign period via the organizer's website and social media channels (in particular Instagram, TikTok, Facebook, YouTube) and communicated to the winner. No additional costs will be incurred by the winner as a result of the handover.
The organizer points out that accepting the prize may incur additional costs, in particular registration fees, insurance and regular maintenance. Any additional costs associated with accepting the prize must be borne by the winner. The winner is responsible for any taxation of the prize.
e) Exclusion
The prize is handed over as it was presented in phase six during the retail tour. Adjustments to the design of the prize handed over may affect the market value. The organizer expressly points out that the prize is a used car. There are no warranty claims against the organizer, as the prize is given to the winner free of charge; in particular, there is no sale of consumer goods. The organizer assumes no liability for any damages incurred in connection with the prize to the extent that an exclusion of liability is permitted by law.
Any liability for damages on the part of the organizer and its executive bodies, employees and vicarious agents arising from or in connection with the campaign, regardless of the legal grounds, is - to the extent permitted by law - limited to cases of intent or gross negligence.
7. Other
a) Restrictions
The prize is neither transferable nor assignable. Exchange or payment in cash is excluded. If circumstances so require, the organizer is entitled to replace the prize with another prize of equal or greater value.
b) Changes to the conditions of participation
The organizer reserves the right to make adjustments to the conditions of participation.
c) Exclusion from participation
The organizer is entitled to exclude participants from participation or from winning in the event of a breach of these conditions of participation or in the event of suspected manipulation or other fraudulent behavior. This includes, for example, attempts to influence the participation process, e.g. by disrupting the process, multiple registrations or similar. If the conditions for exclusion from participation are met, the organizer is also entitled to reclaim any prize awarded. The organizer also reserves the right to take further legal action in such cases.
d) Premature termination
The organizer reserves the right to modify, suspend, cancel or terminate the promotion at any time without prior notice and without giving reasons if the implementation and/or handling of the promotion cannot be guaranteed for legal and/or factual reasons, in particular if there is suspicion of manipulation. In such a case, the participants are not entitled to any claims against the organizer.
8. Publication/Data Protection
a) Processing of personal data
For participation in the campaign, the organizer as the controller within the meaning of Art. 4 No. 7 GDPR collects personal data of the participants via the registration form. This includes, in particular, surname and first name, address, telephone number, e-mail address and the registration details of the respective CO-DRIVER.
The organizer processes this personal data exclusively for the implementation of the campaign. The legal basis is Art. 6 para. 1 lit. b) GDPR. The organizer will delete the personal data collected in the course of the campaign six months after the campaign has been completed, unless another legal basis justifies further storage. There may be longer retention periods for the winner's personal data, e.g. pursuant to Section 257 HGB, Section 147 AO.
The processing of personal data for the purpose of carrying out the campaign entitles the organizer in particular to
- store the personal data and process it for the purpose of determining the prize, notifying the winner and handing over the prize;
- publish the name and, if applicable, photos of the winner on its own website at https://ooono.com/pages/win-a-car and on the organizer's social media channels (e.g. Instagram, TikTok, Facebook, YouTube) as part of reporting on the campaign, the prize draw and the presentation of the prize.

b) Cooperation with the organizer
The participant declares his/her willingness to participate in the event of winning,
- to respond to requests for interviews from the organizer or the media in connection with the campaign,
- to participate in the production of image and film material (e.g. public award ceremony, photo shoot; interview) and
- to agree to the publication of the material created on the organizer's website at ooono.com and on its social media channels (in particular YouTube, TikTok, Instagram and Facebook) for the purposes of corporate communication and marketing
c) Recipients of data
The personal data will only be passed on to third parties if this is necessary for the implementation of the campaign, including the determination and handover of the prize. customer.io is used as a processor in accordance with Art. 28 GDPR.
9. Applicable Law/Legal Process
This promotion is subject exclusively to the law of the Federal Republic of Germany. German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and German private international law. Legal recourse is excluded.
10. Severability Clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision.
