TERMS OF USE (OOONO-APP)

1. ABOUT OOONO
These Terms of Use govern your use of the App and any in-app subscription to digital services. The purchase of physical OOONO products is governed separately by OOONO’s Terms of Service, available at https://ooono.com/policies/terms-of-service. The processing of your personal data is governed by the OOONO Privacy Policy, available at https://ooono.com/policies/privacy-policy. In the event of a conflict, the document specifically applicable to the relevant transaction or service shall prevail.
OOONO A/S (hereafter: “OOONO”) sends you the latest traffic information while you are driving using our application “OOONO” (hereafter: “the App”) to, among other things, warn you about speed traps and road hazards. The App gives you the freedom to specify what real-time information you want about road safety and when you want it. You can read more about the App’s functionalities on our website, www.ooono.com (hereafter: “Website”).

2. ADOPTION OF CONDITIONS
These terms (hereafter referred to as “Terms”) for the use of the App regulate the relationship regarding the use of the App between you as a user and OOONO.
It is a condition of the use of the App that you agree to the Terms. Otherwise, unfortunately, you will not be able to use the App.
If you are under the minimum age required to provide valid consent under the laws of your country of residence, you must obtain approval from your parent(s) or legal guardian(s) before accepting the Terms. In the European Union, the minimum age varies by country but cannot be lower than 13 years. For example, in Denmark, users between 13 and 15 years old must have authorization from their legal guardian(s), while in Germany, guardian authorization is required until the age of 16.
By agreeing to these Terms, you agree that the App is only intended to be used as an aid while driving. The use of the App is at your own risk. Legislation regarding the use of the App may vary from country to country, and you are solely responsible for complying with applicable country-specific legislation, including, for example, traffic laws. OOONO is not liable for your possible violation of the law and the consequences, such as criminal liability, prosecution or fines issued to you.

3. APP FUNCTIONALITIES
The App is made available through the Apple App Store and the Google Play Store; your download and use of the App from those stores is also subject to the respective store terms.
To take advantage of the App’s functionalities, the App requires Bluetooth connectivity between the App and your OOONO CO-DRIVER (hereafter: “CO-DRIVER”). You must connect your CO-DRIVER directly via the App. It is not possible to connect your CO-DRIVER under the Bluetooth settings of your mobile phone. Please note that the App cannot provide information to you if your phone’s Bluetooth connection is not turned on.
The quality of the App in terms of speed and ease of use may vary depending on the specific phone model as well as signal strength. OOONO accepts no responsibility for your Bluetooth connection and your phone’s possible impact on the App’s usability.
The App is designed to function on a range of mobile devices and operating system versions. However, OOONO does not guarantee compatibility with all devices or operating system versions. Older versions of operating systems may not be supported, and the App’s functionality may be limited or unavailable on such versions. It is the user’s responsibility to ensure their device meets the necessary system requirements for using the App. OOONO reserves the right to discontinue support for certain operating system versions at its discretion and without prior notice.
User profile
You must create a user profile in the App. You must create a profile by at least entering your name, gender and email address. You will then receive an activation code to verify you as a user of the App. The profile you create is for your own personal use. If you do not provide the above information, you cannot create a user profile or use the OOONO app.
Login
When you register in the App, you will receive an activation code on the email you provide when creating your user profile. Every time you log in to the App, you will receive a code via your email. You are therefore obliged to ensure that you have access to your email.
If you experience misuse of your user profile, you must contact OOONO immediately using the contact information above.
Updating data
You guarantee that the information registered under your user profile is correct.
At the same time, you are obliged to update the information registered under your profile continually so that the information is current and always correct.
If you provide incorrect information, OOONO may choose to delete your account, just as incorrect information is a breach of the Terms, cf. section 11.
OOONO cannot be held liable for the consequences of any incorrectly entered information.
CO-DRIVER
OOONO alerts you when you are approaching a speed trap (e.g., mobile and fixed cameras) or encountering road hazards (e.g., heavy traffic, accidents, and similar situations) in more than 60 countries.
Also, with one and two clicks on your CO-DRIVER, you can share traffic information with your fellow drivers and help warn others about roadworks and other dangerous situations on the road, as well as tell them about or confirm speed traps.
4. PREMIUM FEATURES AND PAID SOFTWARE SERVICES
Scope.
OOONO offers optional paid subscriptions to digital services and premium features within the App (the “Subscription”). Each Subscription is concluded directly between you and OOONO. If OOONO introduces new premium features or payment models beyond those described in this section, users will be notified in accordance with Section 12 at least 30 days in advance. If you do not wish to subscribe, you will continue to have access to a basic version of the App with limited functionalities.
Certain Subscription features, including Mileage Book, may not be available in all countries. The features available to you are indicated in the App based on your country of residence. OOONO reserves the right to make features available in additional markets or to withdraw features from markets at any time, subject to the notice requirements in section 12.
Mileage Book.
Mileage Book is an optional paid in-app feature that automatically records your driving trips when your CO-DRIVER is connected. Trips are recorded including route, distance, duration and trip category. You can review, categorise, delete and export your trip history within the App. For details of how trip data is processed, including your rights regarding that data, please see the Privacy Policy.
Performance of the Mileage Book service begins - and the right of withdrawal expires accordingly - upon the recording of your first trip, whether triggered automatically by a connected CO-DRIVER or added manually by you.
Subscription (in-app).
The applicable Subscription plan, price (including VAT), billing period (e.g. monthly or annual) and any trial or introductory period are displayed in the App before you confirm your order. By confirming the order in the App, you accept these Terms and the Subscription becomes binding. By confirming the order, you also agree that OOONO begins providing the digital services immediately upon first active use of the relevant paid feature, as further defined for each feature in this section and you acknowledge that you thereby lose your right of withdrawal once the service has been in active use. More information about your withdrawal right can be found in this section below.
Payment.
Subscription payments are processed by an authorized payment service provider using the payment methods made available in the App, which may include credit and debit cards, PayPal, Apple Pay and Google Pay. The first payment is collected upon activation of the Subscription; subsequent payments are collected at the start of each new billing period. All prices are stated inclusive of VAT. OOONO is not responsible for any currency conversion fees or additional charges applied by your bank or payment provider.
If a payment cannot be collected from your designated payment method, you will be notified and given 7 days to re-authorise the payment. If payment is not successfully collected within this period, your Subscription will be cancelled and access to all paid in-app features will cease immediately upon expiry of the 7-day period.
Automatic renewal and price changes.
Unless cancelled in accordance with the cancellation clause below, the Subscription automatically renews at the end of each billing period at the then-applicable price. For monthly Subscriptions, the renewal period is one month. For annual Subscriptions, the initial term is 12 months; after expiry of the initial term, the Subscription automatically continues on an indefinite basis and may be cancelled at any time with one month’s notice.
OOONO will remind you by email at least 30 days before the end of your annual billing period that your Subscription is due to renew, including instructions on how to cancel.
OOONO may adjust the Subscription price for objectively justified reasons, including changes in the cost of providing the service, inflation, changes in applicable taxes or regulatory requirements. Any price increase will be reasonable and proportionate to the underlying reason for the change. OOONO will inform you of any price increase at least 30 days before the change takes effect, by email to the address associated with your account. If you do not wish to continue at the new price, you may cancel your Subscription before the change takes effect in accordance with the cancellation clause below; if you do not cancel, the new price will apply from the next billing period following the effective date of the change.
Right of withdrawal
As a consumer you have the right to withdraw from the Subscription contract within 14 days of the date on which the contract was concluded, without giving any reason.
To exercise your right of withdrawal, you must notify OOONO before the withdrawal period expires. You may do so by sending a written statement to OOONO A/S, Gearhalsvej 1, 2500 Valby, Denmark or by email to support@ooono.com, or by completing the withdrawal form set out below.

Expiry of the right of withdrawal (First active use).
By activating the Subscription in the App, you expressly request that OOONO begins providing the digital services before the 14-day withdrawal period has expired.
You acknowledge that your right of withdrawal expires upon OOONO’s from the moment you first actively used a paid feature included in your Subscription.
Consequences of withdrawal.
Where you validly withdraw before the Subscription has been activated, OOONO will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which your withdrawal declaration was received, using the same means of payment as you used for the initial transaction.
Where you withdraw after the Subscription has been activated and you have first actively used a paid feature, no refund of payments already made will be due.
Cancellation of the Subscription.
You may cancel your Subscription at any time, without giving any reason, with effect at the end of the current billing period. To cancel, please use the cancellation function available in the App under your Subscription settings or contact our customer service at support@ooono.com. Following a valid cancellation, your access to the paid digital services will end at the end of the billing period in which the cancellation takes effect. OOONO does not provide pro-rata refunds for the unused part of an ongoing billing period.
For monthly Subscriptions, cancellation takes effect at the end of the current monthly billing period. For annual Subscriptions, cancellation during the initial annual term takes effect at the end of the prepaid annual period.
Account deletion and effect on active Subscriptions.
If you choose to delete your OOONO account while an active Subscription is running, your account and all associated personal data will be deleted in accordance with our Privacy Policy and applicable data protection law. Once deletion has been completed, the account cannot be restored and all associated data, including Subscription access and history, preferences and usage data, will be permanently removed. Deletion of your account does not entitle you to a refund of any prepaid Subscription fees for the remaining billing period(s). If you have an active annual Subscription, we recommend cancelling your Subscription before deleting your account. If you wish to use the App again after account deletion, you will need to create a new account and, if desired, purchase a new Subscription.
Conformity of digital services and updates.
OOONO will supply the paid digital services in conformity with the contract and provide necessary updates (including security updates) for the duration of the Subscription. You are responsible for installing updates within a reasonable time; OOONO is not liable for any lack of conformity caused solely by your failure to do so.
Changes to the Subscription features.
The digital services and premium features included in a Subscription may evolve over time. OOONO may modify, add, or adjust Subscription features as part of the ongoing development of the App, provided the core functionality remains available. Where a change materially reduces the features available to you, OOONO will notify you in advance in accordance with Section 12.
5. COMMUNICATION
OOONO may keep you informed on an ongoing basis of important information, e.g., about changes to these Terms (hereafter: “Service Announcements”) using the email address you have provided.
For example, if you experience technical issues or have questions about the use of OOONO’s services, you can use OOONO’s support solutions by calling us or sending an email.
6. CONSENT TO RECEIVING NEWSLETTERS
If you give your consent, you agree that OOONO may continually send you emails in the form of newsletters, which may contain marketing and marketing materials relating to OOONO’s product range, to the email address you have provided to us.
You can revoke your consent to receiving newsletters at any time by pressing the “Unsubscribe Newsletter” link, which you will find at the bottom of each newsletter, or through the settings directly in the OOONO app.
You can sign up for our newsletters on our Website, in connection with the creation of a user profile or afterwards in your OOONO app settings.

8. RIGHTS AND LICENSE
Rights
OOONO holds all rights, including property rights, copyrights, patent rights, and trademark rights, etc., to the App.
The App uses software for which the rights belong to third parties but to which OOONO has the right of use.
OOONO reserves the right to initiate legal proceedings against anyone infringing OOONO’s intellectual property rights.
The rights to marketing materials made available to you belong to OOONO.
Right of use
By agreeing to the Terms, you are granted a time-limited, revocable, non-exclusive right of use for the use of the App. Any other use of the App is not permitted without a separate agreement with OOONO.
Your right of use is always subject to you maintaining a user profile in the App and complying with these Terms and having been provided with our Privacy Policy. If your agreement with OOONO ends – for whatever reason – you must immediately discontinue the use of the App.
Upon receipt of marketing materials through the App, you are only entitled to use such marketing materials for the purpose intended in the App.
Also, you may not duplicate, imitate, or copy material that you have accessed directly or indirectly through OOONO in a manner suitable for disinforming about or discrediting OOONO or OOONO’s partners at any time. Similarly, you must not contribute to the use of OOONO’s business characteristics or OOONO’s business partners’ characteristics at any time are used in a way that may give rise to a risk of confusion with other characteristics.
9. DEFAULT
Non-compliance with the Terms constitutes a material breach that may result in the termination of your agreement on the use of the App.
Any automated use of the App, manipulation, or misuse of this or OOONO-relevant data and the like constitutes a material breach of the Terms and will result in the deletion of your user profile.
10. LIABILITY
Disclaimer
The App and the digital services are provided on an “as is” and “as available” basis, subject always to your mandatory rights under applicable consumer law.
OOONO is not liable for indirect losses, including loss of profits, business interruption, loss of data or other consequential losses, except where such liability cannot be excluded under applicable law.
Nothing in these Terms limits or excludes OOONO’s liability for intent, gross negligence, personal injury, death, fraud, or any liability that cannot be limited or excluded under mandatory law.
The App is intended as an aid only. You remain responsible for complying with applicable traffic laws and for exercising due care while driving. Information provided through the App must not be used as a substitute for your own judgment or for compliance with applicable legislation, including traffic rules.
OOONO may make updates, improvements and non-material changes to the App from time to time. Material changes to paid Subscription features are handled in accordance with Section 4 and Section 12.
Force Majeure
Neither party may be held liable for failure to comply with these Terms or any damage suffered by the other party as a result, directly or indirectly, because of force majeure. Force majeure includes war, mobilisation, natural disasters, strikes, lockouts, fires, water damage, trade restrictions, virus or hacker attacks, breakdowns or failures in communication systems, power failures, subcontractors’ force majeure, and other unforeseen circumstances that the party could not prevent by making reasonable efforts.
11. TERMINATION AND DELETION
If you disagree with the Terms or for any other reason no longer wish to use the App, you can delete your user profile at any time.
When uninstalling the App, OOONO will continue to store your personal data in accordance with our Privacy Policy, unless you submit a deletion request.
OOONO may suspend or terminate your access to the App or any paid Subscription if you materially breach these Terms, misuse the App, or use it in a fraudulent, unlawful or automated manner. Where reasonably possible, OOONO will notify you in advance and allow you to remedy the breach, but may act immediately where necessary to protect the App, OOONO, users or third parties.
OOONO may discontinue the App or specific Subscription features for objectively justified technical, legal, security or commercial reasons. If discontinuation is not due to your breach, OOONO will provide reasonable notice and refund any prepaid fees for the unused part of the current billing period, unless mandatory law provides otherwise.
12. CHANGES TO THE TERMS
OOONO reserves the right to modify these Terms when necessary due to objectively justified reasons, such as changes in legislation, the introduction of new app features, or technical adjustments required to ensure the proper operation of the service. Changes will not significantly reduce the user’s rights unless mandated by legal requirements or necessary for security reasons.
Users will be notified at least 30 days in advance before any changes take effect. Notification will be sent via email to the address provided by you.
If you do not accept the revised Terms, you have the right to terminate your use of the App within the notice period. Termination can be done by contacting OOONO by using the contact details provided in section 1.

These Terms were last updated in June 2026 and replace all previously applicable terms.
